FREE Appeals Council review and briefing.

We handle Appeals Council cases for some attorneys and representatives. This is how we work with attorneys and representatives at the Appeals Council level:

  • We will review all ALJ denials you receive. We would ask you to send us all of your ALJ denials for review as a condition of our firm providing FREE Appeals Council review and briefing services.
  • We normally prepare a write-up for cases we accept at the federal level.  We would do the same here.  For cases that we believe there is a meritorious issue, we would prepare a merit review, and convert that merit review into an AC brief. Effectively, we would ghost write the AC brief for you.  We will then send you the completed AC brief arguing the meritorious issues we identified, which you can file in your name and in the name of your firm, and you will file the brief on the ERE.
  • On cases we do not believe have any merit for federal review, and where we did not identify any specific or sufficiently colorable legal errors, will not provide you with an AC brief for filing.
  • WE WILL PERFORM THIS SERVICE FOR FREE.  We will not ask you or the client for a fee agreement for the AC work, and we will not ask for a fee for the AC work.  If you receive a remand and eventually win the case, great.  Keep the fee.  We don’t want a portion of it and we do not want to file a fee petition.
  • Although we will not ask the client for an AC retainer, we will still promptly send out a federal intake packet so the client can send it back to us early.  We would ask you to let the client know that the intake packet is being shipped to them and that they should return it to us if they choose to hire us for the federal appeal, if one should be needed. We would ask for you to facilitate the return of the federal intake packet. We would want the intake packet back from the client before the Appeals Council decides the appeal. Then, once you receive the AC denial, we will already have the intake packet and an open file so we can get the case filed in federal court as quickly as possible. On the other hand, if AC remands, we would also ask to be notified so we can close out the file on our end and so we do not have “phantom” files which will not turn into future federal appeals.
